Sheriff Slocum tells his deputy Jeb Tyler to fetch Kate from the wagon and bids farewell to the driver . Jeb does so, making sure her wrists are manacled behind her. The Sheriff's brainless brother comes forward to tell his story of an unprovoked attack by Kate and ultimately, attempted murder.
Two days before, Kate had been at the at the saloon as usual where she worked as a waitress and barmaid. She had been told to take some drinks upstairs to a room where Jake Slocum, the Sheriff's brother, was being entertained by one of the Red House girls (something Kate refused to do - even though requests for her company were numerous and the money was good). Jake was a rough good-for-nothing, often prone to violent outbursts - especially after too much to drink. When Kate arrived at his room, Jake opened the door, pushed out the girl he'd been with and dragged Kate inside, spilling drinks everywhere. He pushed her onto the bed and in his drunken lust pulled apart Kate's blouse and grabbed her breasts. The quick-witted young woman, realising that rape was on her assailant's mind, managed to push him onto the floor and grab Jake's Colt Paterson from the bedside table. As he got up Kate swung the gun at his head, catching him on the temple and sending him reeling backwards. In the time it took him to recover his senses and stand up, Kate, holding the gun in both hands, pointed at her attacker's head and pulled the trigger. The bullet grazed Jake's skull above his left ear and he fell back to the floor, unconscious.
Realising that that justice would not be with her in this town, Kate gathered herself together, opened the door shouted downstairs that the gunshot was just Jake showing off and there was no damage - a credible story given the reputation around the town of the mindless moron. She left by the back stairs, went to her room above the grocery store, put on boots, breeches and a jacket over her work clothes and headed to the stables where she saddled up the first horse she found and rode quickly out of town.
A day later, however, after a telegram was sent to the next town, Kate was apprehended, spent the night in jail and was returned in the prison wagon to Red Stripes.

"Well now Missy Mortimer", said the Sheriff, "Seein' as you're from this town, you'll know that we take our justice here seriously - and rapidly. And", he continued, "We employ the old-fashioned methods in severe cases like this one where the evidence is real clear". He looked around the crowd. "You nearly killed my brother Jake. And Miss Rodriguez, your ex-employer", he looked at the tall buxom brunette with the top hat, "Well, she's none too pleased about the downturn in her business since the shooting".
He turned his gaze back to Kate. The young woman, though still defiant, knew it was true. She had seen three men whipped at this very post in the year since she arrived here. And all for petty crimes. She hardly dared contemplate what might be in store for her.
"Let's see what this pretty little criminal has under her vest", said Slocum.

All eyes are on the young victim as Tyler grips Kate tightly with both brawny hands while Sheriff Slocum pulls her vest to the side revealing her left breast. Though her stare towards Slocum is contemptuous, inside, her fear was mounting.

Jeb removes Kate's vest completely and takes off her neckerchief, leaving her naked to the waist.
"Bein' that Jake here did actually survive your attempt to kill him, he's mercifully requested that we be lenient with you Miss Mortimer. So instead of the gallows, you'll be whipped."
Kate stared fearfully at the brutal-looking whip in the hand of the Sheriff's equally brutal-looking deputy, Bart.
"Only question is," he continued, "How many lashes."

His sentence elicits gasps from the crowd and a few shrieks from the girls.
"Jake,", he continues, "Give Jeb a hand fixin' her up to the post."
